Welcome to Telerivet, the online and mobile service of Telerivet, Inc. ("Telerivet," "we," "us," or "our"). Our Privacy Policy explains how we collect, use, disclose, and protect information that applies to our Service, and your choices about the collection and use of your information.

Capitalized terms that are not defined in this Privacy Policy have the meaning given to them in our Terms of Service.

Purpose of this Privacy Policy

This Privacy Policy discloses our personal information gathering and dissemination practices with respect to the Service. The Privacy Policy is incorporated into and is part of the Terms of Service. Please read this Privacy Policy carefully.

We have also created this Privacy Policy to demonstrate our commitment to privacy. We recognize that when you provide us with information about yourself and your contacts that you trust us to act in a responsible manner with that information.

Information Telerivet collects from users and how it is used

The following describes the types of personal and other information we may collect about you, and how we use and maintain that information:

Registration
Before you can utilize certain services that we offer on the Service or otherwise, we may ask that you register with Telerivet and provide us with your email address, a password, your name and other contact information. We request this information for identification purposes, to communicate with you regarding your account, and to facilitate the functioning of certain services.
Correspondence
If you correspond with us via email, phone, text, or another method, we may gather the information that you submit in a file specific to you.
URL and IP address
Like many other websites, Telerivet collects information about users' utilization and navigation of our Service. This information helps us to design our Service to better suit our users' needs. For example, our Service will track the URL that you visited before you came to our Service, the URL to which you next go, and your Internet Protocol (IP) address. We use your IP address to help diagnose problems with our server and to administer our Service. Your IP address also is used to help identify you, determine the city, country, and internet service provider from which you are using the Service, and to gather broad demographic information.
Analytics information
Telerivet may directly collect analytics data, or use third-party analytics tools, to help us measure traffic and usage trends for the Service. These tools collect information sent by your browser or mobile device, including the pages you visit and other information that assists us in improving the Service. This analytics data may enable Telerivet to relate your use of our Service to personally identifying information that you previously submitted.
Log file information
Log file information is automatically reported by your browser or mobile device each time you access the Service. When you use our Service, our servers automatically record certain log file information. These server logs may include information such as your web request, Internet Protocol (IP) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed, and other such information.
Information collected with cookies

Like most major websites, Telerivet uses cookies on certain pages of our Service. Our cookies may enable us to relate your use of our Service to personally identifying information that you previously submitted. The information that we collect with cookies allows us to statistically analyze Service usage, to improve our content and product offerings, to improve our marketing and promotional efforts, and to customize our Service's content, layout and services. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Service may not function properly if the ability to accept cookies is disabled.

In addition, Telerivet uses third-party vendors, such as Google, to show ads for Telerivet on sites across the internet. These third-party vendors use cookies to serve ads based on your previous visits to Telerivet's website. To opt-out of these targeted ads, visit the Network Advertising Initiative opt-out page.

User Provided Information
In order to implement the core functionality of the Service, Telerivet stores information that is provided directly by you to the Service, including messages and contact information. When applicable, Telerivet also stores information that is provided by your contacts via incoming messages and calls.
Telerivet Gateway app information
If you install the Telerivet Gateway app on an Android phone, the app will send data from the Android phone to Telerivet's servers in order to implement the core functionality of the Telerivet Gateway app and to allow Telerivet to provide support for any issues related to the app. The data sent to Telerivet's servers includes call logs and SMS and MMS messages, including the content of messages and phone numbers communicated with, as well as information about the phone's status, including its battery level, power status, mobile network connectivity, operating system version, device manufacturer and model, phone number, country, and IP address.
Commercial and marketing communications
We use the information we collect or receive to communicate directly with you. We may send you emails containing newsletters, promotions and special offers. If you do not want to receive such email messages, you will be given the option to opt out or change your preferences. We also use your information to send you Service-related emails (e.g., account verification, purchase and billing confirmations and reminders, technical and security notices). For certain Service-related e-mails, the only way to opt-out is to terminate your account with Telerivet.

To whom Telerivet may disclose information that we collect

Telerivet will not share, rent, sell or otherwise disclose any of the personally identifiable information that we collect about you, except when we have your permission or in any of the following situations:

  • We may disclose information that we collect about you to our third-party partners who perform services for Telerivet in order to provide certain services or to complete or confirm a transaction that you conduct with us. The Third-Party Data Processors page describes the third party entities to which Telerivet currently discloses information about you for these purposes.
  • We may disclose the results of aggregated data about you for marketing or promotional purposes. In these situations, we do not disclose to these entities any information that could be used to personally identify you.
  • Telerivet may disclose information about you as part of a merger, acquisition or other sale or transfer of its assets or business. Telerivet does not guarantee that any entity receiving such information in connection with one of these transactions will comply with all terms of this policy.
  • Moreover, we may be legally obligated to disclose information about you to the government or to third parties under certain circumstances, such as in connection with illegal activity on our Service or to respond to a subpoena, court order or other legal process. Telerivet reserves the right to release information that we collect to law enforcement or other government officials, as we, in our sole and absolute discretion, deem necessary or appropriate.

Who has access to messages and contact information

You may use your account settings to control other Users' access to information associated with your User account, such as messages and contact information. Generally, User Provided Information transmitted through or stored by the Service is only available to those with whom you choose to share such information.

However, please note that any messages transmitted via the Service may be accessible to certain third-party organizations, such as mobile networks and SMS gateway services, that may be used to transmit the messages. These organizations may have their own rules, policies, and security measures controlling who has access to messages transmitted through their services.

Telerivet's employees and contractors generally do not have access to view messages or contact information associated with your User account. However, certain authorized employees and contractors of Telerivet have access to view some data associated with your User account, including profile settings, automated services, log messages, and summary statistics. In limited circumstances, authorized employees or contractors of Telerivet may access other information associated with your User account, including contacts or messages, for the reasons listed in section 1.5 of the Terms of Service.

Security measures employed by Telerivet

Telerivet is certified by an independent auditor to conform to the requirements of ISO/IEC 27001:2013, the leading international standard for information security. This certification demonstrates that Telerivet operates an Information Security Management System (ISMS) that conforms to the requirements of the ISO 27001 standard.

Telerivet has also undergone a System and Organization Controls (SOC) 2 Type 2 audit that assessed the suitability of the design and operating effectiveness of Telerivet's security controls. The SOC 2 Type 2 audit resulted in a CPA's report stating that Telerivet maintained effective controls over the security of the Telerivet system throughout the audit period.

Telerivet regularly engages independent third-parties to conduct application-level penetration tests, and uses a third-party tool to conduct regular vulnerability scans on Telerivet's systems. Security vulnerabilities detected in Telerivet's software and its dependencies are remediated promptly.

To protect the privacy of data you transmit through this Service, Telerivet uses SSL/TLS to encrypt the information that is sent between your device and Telerivet's servers. In addition, Telerivet takes steps to protect the user data we collect against unauthorized access.

All contact data and user data is secure and accessible through the Telerivet service only via user accounts authenticated with a password, API key, or other secure credential. If someone attempts to log in with an invalid password multiple times for the same user account in a short time interval, the user account will automatically be locked for a short period of time in order to prevent automated guessing of user passwords. Users may also enable two-factor authentication via a time-based one-time password (TOTP) distributed by Google Authenticator, SMS, or voice call. Users may also enable a whitelist of internet protocol (IP) addresses that are allowed to access their data.

However, you should keep in mind that this Service and our services are run on software, hardware and networks, any component of which may, from time to time, require maintenance or experience problems or breaches of security beyond our control.

Please also be aware that despite our best intentions and the guidelines outlined in this Privacy Policy, no data transmission over the Internet or encryption method can be guaranteed to be 100% secure.

Where information is stored and processed

Telerivet currently stores and processes information collected through the Service on servers located in the European Union.

Telerivet may transfer information that we collect about you, including personal information, to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. In this case, Telerivet ensures that data transfers comply with the European Union General Data Protection Regulation (GDPR) Chapter 5 ("Transfers of personal data to third countries or international organisations"), the Republic of the Philippines Data Privacy Act and Implementing Rules and Regulations, and the California Consumer Privacy Act (CCPA). The Third-Party Data Processors page describes the third parties to which Telerivet transfers information and the reason for such processing.

If you are located in regions with laws governing data collection and use that may differ from United States, Republic of the Philippines, or European Union law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction. You consent to the transfer of information to any country in which Telerivet or its parent, subsidiaries, affiliates or service providers maintain facilities and to the use and disclosure of information about you as described in this Privacy Policy.

How you can correct or update information that Telerivet collects about you

You may correct or update information collected about you by logging in to Telerivet and editing your account settings, or by contacting Telerivet at info@telerivet.com. We will use reasonable efforts to update our records. For our records, we may retain original and updated information for reasons such as technical constraints, dispute resolution, troubleshooting and agreement enforcement.

You can also stop receiving promotional email communications from us by clicking on the "unsubscribe link" provided in such communications. How you can opt out of tracking

Please refer to your mobile device or browser's technical information for instructions on how to delete and disable cookies, and other tracking/recording tools. Depending on your type of device, it may not be possible to delete or disable tracking mechanisms on your mobile device. Disabling cookies and/or other tracking tools prevents Telerivet or its business partners from tracking your browser's activities in relation to the Service. However, doing so may disable many of the features available through the Service. How long Telerivet keeps your User Content

In most cases, Telerivet stores your User Content until you delete it using the functionality provided in the Telerivet service.

After you delete User Content from the Telerivet service, or following termination of your User account, Telerivet may retain your User Content for a commercially reasonable time for backup, archival, or audit purposes. In no case shall this time be greater than six (6) months following deletion of the User Content or termination of the User account.

How you can be informed of changes to the Privacy Policy

Telerivet reserves the right to update this Privacy Policy from time to time. Please visit this page periodically so that you will be apprised of any changes. When we change the policy in a material manner we will update the "Updated" date at the top of this page.

We may provide you additional forms of notice of modifications or updates as deemed appropriate in our sole discretion or as required by law. Your continued use of the Service after any modification to this Privacy Policy will constitute your acceptance of such modification.

Policy on children users of Telerivet

We do not knowingly collect or maintain personally identifiable information from persons under 16 years old, and no part of our Service is directed to persons under 16. IF YOU ARE UNDER 16 YEARS OF AGE, PLEASE DO NOT USE OR ACCESS OUR SERVICE AT ANY TIME OR IN ANY MANNER. If Telerivet learns that personally identifiable information of persons less than 16 years old has been collected without verifiable parental consent, then Telerivet will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child under the age of 16 has obtained a Telerivet account, then you may alert Telerivet at the address below and request that we delete that child's personal information from our systems.

Jurisdiction-Specific Data Protection Provisions

If you use Telerivet to process data of individuals in the European Union, United Kingdom, the Philippines, or California, or if you are a User who is an individual in one of those jurisdictions, certain additional provisions related to privacy and data protection apply to you. Please see Section 10 of the Terms of Service.

For users subject to the Philippines' Data Privacy Act, Telerivet provides a Privacy Manual that contains additional details about how Telerivet protects information.

If you are an individual in the European Union, United Kingdom, the Philippines, Singapore, or another jurisdiction that provides certain data subject access rights, you can assert those rights by completing the Data Subject Request Form and submitting it via email to dataprotectionofficer@telerivet.com.
